Welcome to Vape Quit Coach. By downloading, installing, or using our mobile application, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By accessing or using Vape Quit Coach ("the App"), you agree to comply with and be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the App.

2. Description of Service

Vape Quit Coach is a mobile application designed to help users quit nicotine and vaping through:

• Streak tracking and progress monitoring
• Breathing rituals and mindfulness exercises
• Personal journaling and mood tracking
• Educational content about nicotine cessation
• Premium subscription features

3. Medical Disclaimer

The App does not provide medical advice. The content, rituals, and suggestions are for informational and motivational purposes only. If you have a medical emergency or are experiencing severe withdrawal symptoms, contact your doctor or call emergency services immediately.

4. User Eligibility

You must meet the following requirements to use the App:

• Be at least 13 years of age (or the age of majority in your jurisdiction)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the App under applicable laws

If you are under 18, you must have permission from a parent or legal guardian to use the App and make purchases.

5. User Account and Data

Vape Quit Coach stores all user data locally on your device. You are responsible for:

• Maintaining the security of your device
• Backing up your data if desired
• Understanding that uninstalling the App will delete all locally stored data

6. Subscription Terms

Premium Subscription

Vape Quit Coach offers a premium subscription with enhanced features. By purchasing a subscription, you agree to the following:

Pricing

• Monthly Plan: $14.99 USD per month
• Annual Plan: $49.99 USD per year (save 70% vs monthly)

Prices are subject to change with notice.

Payment and Renewal

• Subscriptions are processed through the Apple App Store
• Payment is charged to your Apple ID account at purchase confirmation
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your App Store account settings

Free Trial

If we offer a free trial period, you will be charged the subscription price when the trial ends unless you cancel before the trial period expires. Trials are limited to one per user.

Cancellation

You may cancel your subscription at any time through your App Store account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for the remaining portion of a billing period.

7. Refund Policy

All purchases are processed through the Apple App Store and are subject to Apple's refund policies. To request a refund, contact Apple Support directly. We do not have the ability to process refunds.

Apple may issue refunds at their discretion for purchases made within the last 90 days.

8. Acceptable Use

You agree to use the App only for lawful purposes. You must NOT:

• Violate any local, state, national, or international law
• Attempt to reverse engineer, decompile, or hack the App
• Use automated systems or bots to access the App
• Share or distribute content from the App without permission
• Use the App in a way that could harm, disable, or overburden our services
• Impersonate others or misrepresent your affiliation with any entity

9. Intellectual Property

All content in the App, including but not limited to text, graphics, logos, icons, images, audio clips, and software, is the property of Vape Quit Coach or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the App for personal, non-commercial purposes. You may not:

• Copy, modify, or distribute App content without written permission
• Create derivative works based on the App
• Remove or alter any copyright, trademark, or proprietary notices

10. User-Generated Content

Any content you create within the App (journal entries, notes, etc.) remains your property. However, you grant us a license to store and process this content solely to provide the App's functionality.

Since all data is stored locally on your device, we do not have access to your journal entries or personal notes unless you explicitly share them with us (e.g., for support purposes).

11. Third-Party Services

The App integrates with third-party services:

• Apple App Store: For payments and app distribution
• RevenueCat: For subscription management

Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party services.

12. Disclaimers and Limitations of Liability

No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that:

• The App will be error-free or uninterrupted
• Defects will be corrected
• The App will meet your specific requirements
• Using the App will result in successful nicotine cessation

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESCAPE THE VAPE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION ARISING FROM YOUR USE OF THE APP.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE PAST 12 MONTHS (OR $100 USD, WHICHEVER IS GREATER).

13. Indemnification

You agree to indemnify, defend, and hold harmless Vape Quit Coach, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

14. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including if we believe you have violated these Terms.

Upon termination, your license to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination will remain in effect.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Posting the updated Terms in the App
• Updating the "Last Updated" date
• Sending an in-app notification for significant changes

Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of New Zealand, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved through good faith negotiation. If negotiation fails, disputes will be resolved through binding arbitration in New Zealand, except where prohibited by law.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vape Quit Coach regarding your use of the App and supersede all prior agreements.
